CRITIQUE OF Chas Keys and Kevin Short’s Jocko Graves: Maitland’s ‘Little Black Boy’ (26 November 2025)

I am not an “out-of-towner”. As a resident of Maitland, and academically qualified philosopher and educator, I have thoroughly debunked Maitland & District Historical Society’s article by the “esteemed”* Chas Keys and Kevin Short (Jocko Graves: Maitland’s ‘Little Black Boy’, 26 November 2025) in my Book Maitland’s Racist Garden Gnome (available on Amazon). I have used philosopher Michel Foucault's deconstruction methodology of history on the subject matter.

Chas Keys and Kevin Short have no university qualification in history. Both are amateur history fans and members of Maitland and District Historical Society. I encourage them to critique my book correctly by refuting the central point. This is the best way to respond but it involves time and effort. One needs to understand, and correctly describe, the central point in order to refute it. A secondary or tertiary point is not the central primary point. Hence Kevin Short’s reply to me that “Insult is not discussion” (referring to the title of my book) is not a proper refutation. It’s a complete misunderstanding of the title.

Here is a very short critique of their poorly researched opinion piece. Read the full critique in my book.

POSITIVE

1. Short / Keys correctly state that there is a hitching post on High Street, Maitland.

2. Short / Keys write in grammatically correct sentences (unlike some other Penfold Philistines).

NEGATIVE

1. Short / Keys repeat an often told myth of Jocko Graves. The whole alleged 'history' of 'Jocko' is based upon a fictional children's book written by Earl Koger Snr in 1963. There is no verifiable evidence that he ever existed. There is only distorted oral tradition of Jocko Graves incorrectly written down as fact 250 years after his supposed adventure took place. That means that Jocko Graves is not a hero as his supposed actions in the myth are also fictitious.

2. Short / Keys use the name ‘Jocko’ for the hitching post. The hitching post was called 'the little black boy' (no 'Jocko') from the mid 1890s when it appeared on High Street until mid 20th century. The term 'black boy', used to describe the object, was not one of endearment but one of racist denigration. 'Black boy' was a term used by white people in Maitland to describe adult Aboriginal trackers.

3. Short / Keys repeatedly call the hitching post a statue. The hitching post isn't a statue (a civic monument). It's a mass-produced 19th century gimmick used to promote the sale of American tobacco (which has strong ties to both slavery and racism). It's like a Ronald McDonald figure outside a Maccas store to sell hamburgers. The hitching post was outside a tobacconist to sell tobacco grown and harvested by slaves.

4. Short / Keys Short / Keys fail to understand that the Jim Crow Museum of racist artefacts views the ‘Jocko’ hitching post as a “demeaning relic... of a racist past”.

5. Short / Keys argue “It’s old therefore it’s important”. This is the logical fallacy (error of reasoning) called Appeal to Tradition (argumentum ad antiquitatem, appeal to age, proof from tradition) There may well be a good argument for the object’s importance, but merely saying that it is old is not sufficient justification. It is not a reason in itself but requires more information.

6. Short / Keys personify an inanimate object by using the term “he”. They also borrow (without proper acknowledgement) the lyrics of Byran Watkins’ ‘Maitland’s Black Boy’ song. The song lyrics use the same personification of the hitching post as they use. They state that they don’t know the date of the song’s publication. A simple Google search could have been used to find the date. It was 1977.

7. Short / Keys state that the hitching post is featured on many used items. Having a racist object on many used items does not negate the object’s relation to both slavery and racism. Black slave children were used to grow and harvest tobacco. The hitching post was used to tie up horses. Both items are used by others.

8. Short / Keys state that the hitching post is not racist. It is very clear that the context of Maitland's vomiting hitching post is tied to tobacco advertising. That tobacco was grown and harvested by black slaves in America. The object was situated outside a tobacconist store. Maitland's vomiting hitching post exists because of the slavery associated with the American tobacco industry of the day. It's appearance on High Street in the late 1800s was in the context of racism within both Maitland and Australia.

9. Short / Keys don’t understand how oral tradition works. They think that it is like Chinese Whispers. As a teacher, I have used this game with young students. The message at the end has always been distorted. This is partly because the original message does not use mnemonic devices such as acronyms, acrostics or rhymes. Songlines and method of loci (memory palace) are part of the spread of Aboriginal oral tradition. There is no evidence that songlines, method of loci or mnemonic devices have been in play with the retelling of the Jocko Graves myth.

10. Short / Keys use a false dilemma fallacy (also known as a false dichotomy, black-and-white thinking, or the either/or fallacy) in attempting to justify their faulty view of oral tradition. You either choose the whole of the Jocko Graves myth and all of aboriginal oral tradition or you reject the whole of the Jocko Graves myth and all of aboriginal oral tradition. It doesn’t work that way. There are many other choices and not merely this absolutist thinking which oversimplifies complex issues.

11. Short / Keys state that there is a ‘way forward’ by believing their ahistorical misinformation. However, believing their misinformation is actually a way backwards to a 19th century racist white Australia.

12. Short / Keys list the main ‘historians’ that they quote as references for their assertions. They are all unqualified amateur history fans. None have a university qualification in history.
- Earl Koger Sr., an insurance broker.
- Waymon E Lefall, a barber.
- Jack Paten ("Drongo Jack"), an Australian country musician.

Will history fans Chas Keys and Kevin Short correct their obvious errors or continue to defend the indefensible?

* It’s a short story that I will tell sometime. ;-)

Note the barber banner in the background honouring "historian" Waymon E Lefall, the barber. The vomiting fountain hitching post is also photographed in a typical Maitland (City of Excitement) landscape with an abandoned shopping trolley. Both book and song debunk the nonsense written by amateur history fans on, what they call, "Jocko - The Little Black Boy". ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

A groundbreaking new book by philosopher and educator Mark Tindall delivers a sharp, evidence-based correction to local folklore. Maitland’s Racist Garden Gnome dismantles popular myths surrounding the well-known local artefact, Maitland’s ‘Little Black Boy’, exposing its true origins as a gimmick from slave owning American tobacco companies to sell tobacco.

Tindall’s book establishes a critical distinction between searching for historical trivia with superficial data gathering and performing rigorous historical research.

While conservative defenders fight to distance the object from its toxic past, Tindall’s evidence delivers an undeniable verdict: the artefact was never intended as a civic monument. Instead, it functioned as a commercial gimmick utilised by American tobacco companies—an object inextricably tied to American slavery and racism.

Maitland’s Racist Garden Gnome systematically unpacks the errors that led to the myth:

  • The Fiction of Jocko Graves: The book conclusively proves that Jocko Graves—the folklore figure often associated with lawn jockeys—is a fictional character who never existed.
  • A Fused Myth: Tindall demonstrates how amateur history fans erroneously fused the physical fountain hitching post with the fictional Jocko Graves legend, creating a false narrative that needs to be permanently separated.

Structured as a methodological guide, the book provides readers with essential tools for reliable historical research. It evaluates previous claims made by amateur history fans while drawing insights from institutions like the Jim Crow Museum of racist artefacts. Tindall concludes by examining the errors of reasoning common among local history fans, comparing the evolved folklore to a modern fairy tale.

Maitland’s Racist Garden Gnome is a vital read for anyone interested in Maitland’s history, and the preservation of verifiable truth over convenient local myths.

The middle lyrics state:
Jocko is a black slave child
Slavery is the worst form of racism.

The song contains a hidden back-masked message that can only be heard if you play the song backwards. If you do so, please don’t reveal the message. I want it to be a surprise.

MAITLAND'S RACIST GARDEN GNOME - New Book Debunks Local Maitland Myth, Exposing Links to Black Slavery, Racism and "Amateur History" Errors

OUT NOW! New Book Debunks Local Maitland Myth, Exposing Links to Black Slavery, Racism and "Amateur History" Errors

MAITLAND, NSW — A groundbreaking new book by philosopher and educator Mark Tindall delivers a sharp, evidence-based correction to local folklore. Maitland’s Racist Garden Gnome dismantles popular myths surrounding the well-known local artefact, Maitland’s ‘Little Black Boy’, exposing its true origins as a gimmick from slave owning American tobacco companies to sell tobacco.

MAITLAND’S ‘LITTLE BLACK BOY’ IS NOT A STATUE OF THE MYTHICAL JOCKO GRAVES BUT A HITCHING POST TO SELL TOBACCO

Maitland’s vomiting fountain hitching post, currently known as the ’Little Black Boy’, had no front page news when it was first placed on Maitland’s High Street in the late 1800s. It wasn’t hailed as an important statue. It wasn’t a statue (a civic monument) at all but a vomiting fountain hitching post. It was created as a fountain which vomited water into a horse trough but since Maitland was not connected to a water supply that function never operated. Local children valued the vomiting fountain hitching post so much that they put sticks and pipes in its mouth! Eventually the mouth was sealed.

It was the equivalent to a Ronald McDonald figure placed in McDonalds restaurants in the 1970s and 1980s. It was a sales gimmick to get more people to buy a product. The Ronald McDonald figure was used to get people to buy hamburgers. Maitland’s racist garden gnome was used to get people to buy American tobacco that was grown and harvested by black slaves. Slavery is the worst form of racism. Slaves were legally treated as property and completely stripped or their human rights. This was based solely on the slaves' 'race' / skin colour. It is very clear that the context of Maitland's racist garden gnome is tied to tobacco advertising. That tobacco was grown and harvested by black slaves in America. The object was situated outside a tobacconist store. Maitland's racist garden gnome exists because of the slavery associated with the American tobacco industry of the day. It's appearance on High Street in the late 1800s was in the context of racism within both Maitland and Australia.

Jocko Graves is a myth first written about in a children’s picture book by Earl Koger Sr
(an insurance broker), The Legend of Jocko: The Boy Who Inspired George Washington” (1963). The black slave child never existed in time space history. There is no verifiable evidence that he ever existed. There is only distorted oral tradition of Jocko Graves incorrectly written down as fact 250 years after his supposed adventure took place. That means that Jocko Graves is not a hero as his supposed actions in the myth are also fictitious.

Waymon E Lefall (an American barber), first incorrectly linked the legend of Jocko Graves to the hitching post in his book, The Legend of Jocko: child Hero of the American Revolution (2003). Australian Jack Paten (known as country musician Drongo Jack), wrote to Waymon E Lefall and suggested a trip to Maitland. Lefall did so in 2009. Jocko:A Long Way from Home Down Under (2014) chronicles his visit to Maitland. Waymon E Lefall asserts, but provides no verification, that Maitland’s racist garden gnome is compared to the American Statue of Liberty, the Sydney Harbour Bridge, and the French Eiffel Tower. He incorrectly asserts that it “can be found in Maitland Australia. Where Jocko the first American child hero is located in the banks, city council office and on the curb side.” Maitland’s racist garden gnome is only found publicly at the Maitland Mutual building society main office in Maitland and not in all banks.

Neither Earl Koger Sr, Waymon E Lefall or Jack Paten (Drongo Jack) are historians with a university qualification in history. Don’t be fooled by history fans.

HOW TO CRITIQUE MY BOOK, MAITLAND'S RACIST GARDEN GNOME

If you disagree with what I have presented in my book, Maitland's Racist Garden Gnome, then how should you address my supposed error?

1. The most important thing is that you must read my book first. You can't validly criticise a book without reading it. When writing my book, I read all the ahistorical nonsense from history fans in order to critique their nonsense.

2. Choose the best way to critique rather than the worst way. Refute the central point.

The following is from Paul Graham’s disagreement hierarchy (Paul Graham, How To Disagree, March 2008) which I have broken up with my own comments between points. This is an excerpt from my book.

~~~~~~~~~~~~~~~~~~~~~~~~~~
The worst ways to respond.
DH0. Name-calling.
This is used by your average social media troll. They don’t address the topic, they just insult the writer.
DH1. Ad Hominem.
This is a logical fallacy where one attacks the supposed character, motive, or personal trait of the author rather than addressing the argument.
DH2. Responding to Tone.
This is a response to the manner in which the writer has presented the argument. What the writer writes is far more important than how the writer writes. Responding to the author’s tone does nothing to address the argument.
DH3. Contradiction.
You disagree? So what? Stating an opposition to the argument, with little or no supporting evidence, is not properly addressing the argument.
DH4. Counterargument.
Although counterarguments sometimes contain useful points they often contain straw man fallacies. In this error of reasoning, the original argument that the author stated is replaced by a different argument that is easier to attack. It is a misrepresentation of the original argument and thus does not address the original argument, only a false representation of that argument. Make sure you understand what was originally stated by the author.
The better ways to respond.
DH5. Refutation.
This involves time and effort. You quote the source and explain why it is wrong. This may involve quoting experts in the field of study. The best expert is a person with a PhD in the exact subject area. A history fan is not an expert. This response, however, is not definitive as experts may disagree. Quoting an expert out of context is an error of reasoning called cherry picking. One should quote an expert in the context of their entire text.
DH6. Refuting the Central Point.
This is the best way to respond but it involves time and effort. One needs to understand, and correctly describe, the central point in order to refute it. A secondary or tertiary point is not the central primary point.
Two of my songs from my new album Sirens Before Dawn have been shortlisted in the Australian Songwriters Association Songwriting Contest: Australia On A Pale Blue Dot & Sound Paint (Parts 1, 2 and 3).
- Australia On A Pale Blue Dot
LYRICS - AUSTRALIA ON A PALE BLUE DOT X
It was my fate that day
Falling through blue screen
I was in a new world
Well, that’s what it seemed
The man outside Hoyts
Told me everything
He spoke about the elephant
That wasn’t anything
CH: Australia on a pale blue dot / That’s all that we’ve got
Galah caught on fire
Black swan appeared
Flying pig circled high
Before it was speared
It looked like a pork chop
That would make a decent feed
Blowie settled in my beer
Ankle biter on my knee
Threw a barbie on the shrimp
Petrol on the fire
The goon bag was on the hoist
Wound it up lots higher
Numpty doofus gave a shout
I gratefully accepted
It was only a half glass
More than I expected
Dipstick was fooling round
Bush telly going well
Threw a bunger in the dunny
Blew the place to hell
Startled, I woke up
Everything was fine
All my teeth were wisdom teeth
Vinegar turned to wine
- Sound Paint (Parts 1, 2 and 3)
LYRICS - SOUND PAINT - Part 1
When your words are exhausted
And lie silent on the ground
Paint with sound
GIORDANO BRUNO WAS NOT A MARTYR FOR SCIENCE
Giordano Bruno did no science and was not a scientist. Bruno was a follower of a movement called Hermetism, which was a cult that based its beliefs on documents which were thought to have originated in Egypt at the time of Moses. These writings were linked with the teaching of the Egyptian God Thoth, the God of learning and had arrived in Italy from Macedonia in the 1460s. To followers of this cult, Thoth was known as Hermes Trismegitus, or Hermes the thrice great. The book of Toth placed the sun at the centre of the universe. This is what Bruno followed. No science - only adoption of Hermeticism. He was jailed and executed because the church considered him a heretic. The church wanted him to just recant his claims that Hermetism was the one true religion not because of his claims about the universe.
From Routledge Encyclopedia of Philosophy
4 Cosmology
Bruno is best known for his championship of Copernicus in
The Ash Wednesday Supper. In De Revolutionibus Orbium Coelestium (On the Revolutions of the Heavenly Spheres) (1543), Copernicus had argued both that the earth had its own daily rotation, and that it rotated around the sun (see Copernicus, N.). These theses challenged Aristotelian cosmology, but the force of the challenge was recognized only gradually. It was not until 1616 that De Revolutionibus was put on the Index of books forbidden by the Roman Catholic Church, and ironically, it may have been in part Bruno’s defence of Copernicus that led to this result, for he pointed out that Copernicus’ theory was inconsistent with the standard ways of interpreting the Bible at that time. Bruno took Copernican cosmology more seriously and less metaphorically than Yates suggests when she writes ‘The sun-centred universe was the symbol of Bruno’s vision of universal magical religion, inspired by the works of "Hermes Trismegistus"’ (Yates 1982: 219). Nonetheless, it is true that Bruno showed little interest in the mathematical basis of Copernicus’ work. He criticized Copernicus for ‘being more intent on the study of mathematics than of nature’ ([1584a] 1975: 57), a point which ties in with his other attacks on mathematics, and his emphasis on numerology in such writings as De monade. Moreover, Bruno got some of the technical details wrong, perhaps because he was drawing on the writings of a French bishop, Pontus de Tyard, who was favourable to Copernicus, but muddled.
In both The Ash Wednesday Supper and On the Infinite Universe and Worlds Bruno makes a series of cosmological claims that owe much to Lucretius and Nicholas of Cusa. First, the universe is infinite, which means that it can have no centre, though there are many world-systems each of which may have its own centre. Second, these worlds may be inhabited. Third, the stars can be regarded as suns, that is, as self-luminous bodies, and they should not be seen as fixed on spheres. Fourth, the earth is made of the same stuff as the other worlds: there is no difference of kind between the sublunar realm and the heavenly realms, as Aristotelians argued. Finally, the celestial bodies that constitute the universe are ‘intelligent animals’ ([1584a] 1975: 46). Indeed, it is because the earth is animate that it must rotate. It has an ‘innate animal instinct’ ([1584c] 1950: 266), and there is no need to postulate extrinsic movers.
TRUMP DENIAL SYNDROME (TDS)
Trump Denial Syndrome is manifested by excusing any and all behaviour by their leader. Any wrongdoing, even after verifiable evidence, is immediately dismissed. Fearing any information that may contradict their leader, they simply refuse to view it and often react with anger and name calling. Trump Denial Syndrome adherents identity becomes wrapped up in their allegiance to their leader, whom to them can do no wrong, so challenging them is almost impossible. Believing the truth would acknowledge that they’ve been lied to, and that would diminish both their hero and their self esteem.
"YOU WERE NEVER A TRUE CHRISTIAN!" - NO TRUE CHRISTIAN FALLACY
NO TRUE CHRISTIAN FALLACY
FORM
Person A: "No Christian ever leaves Christianity."
Person B: "But I was a Christian and I left Christianity. "
Person A: "But no true Christian ever leaves Christianity."
This accusation is a classic "no true Scotsman" argument because it attempts to redefine ad-hoc what a Christian is.
According to the definition, no person could ever have been a Christian if they leave Christianity at some point in the future.
It would be impossible using this criteria - the abandoning of a religion - to determine who, among current Christians, is actually a "true Christian". How many unwitting imposters attend church every week? How come the true Christians were never able to "sniff these impostors out" while these "fakes" were still attending the same religious rituals as obediently as possible? This is clearly absurd.
Mandatory Bible Verse For Trew Kristyuns: 1 Samuel 16:7 “The Lord does not look at the things people look at. People look at the outward appearance, but the Lord looks at the heart.” (In other words, according to this bible verse, you cannot tell who is, or is not, a true Christian. Only God knows.)
WHAT IS A JESUS JINGLE?
Jesus Jingles are banal "Jesus is my boyfriend" chouses interspersed with the "Pente Mantra".
For decades in Christianity I witnessed "worship" as singing Jesus Jingles to the fictitious mythical Christ of Faith (all denominations). The jingles weren't even addressed to God. However, in all but Catholic and Anglican churches, singing Jesus Jingles is the main feature of a Sunday service. There is nothing similar in any part of contemporary secular culture. "Join us at our Worship Service" means "Join with us to sing Jesus Jingles in our crowd".
I honor, respect and love my wife. I don't sing to her: "Praise the wife! Hallelu-wife! Glory to the wife of this household! You're the best wife in all the universe! Bless the wife, oh my soul! Worship her holy name. Sing like never before, my soul". If I organised a time to sing this weekly to my wife she'd be seeking to get me urgent psychiatric help. Yet this is exactly how Christians treat the fictional mythical Christ of Faith. This is the Pente Mantra.
I parodied this in an original song: "Hallelujah! Please the hordes! Bless the Lord one way! Glory to God I speak in tongues and talk in trite cliches!"
The historical Jesus of Nazareth, a practising Jew, would be horrified if he he returned to earth today and heard this banal nonsense.
GOD versus JESUS - Yeshayahu 9:5 versus Isaiah 9:6
An example of a totally different translation and thus a totally different meaning.
Yeshayahu (Isaiah) 9:5* (Jewish Tanach) - For a child has been born to us, a son given to us, and the authority is upon his shoulder, and the wondrous adviser, the mighty God, the everlasting Father, called his name, "the prince of peace."
Isaiah 9:6 KJV - For unto us a child is born, unto us a son is given: and the government shall be upon his shoulder: and his name shall be called Wonderful, Counsellor, The mighty God, The everlasting Father, The Prince of Peace.
* Note the different verse number, the different tense and the different subjects of the adjectives.
So ...
- Is God called the the wondrous adviser, the mighty God, the everlasting Father?
or
- Is Jesus called Wonderful, Counsellor, The mighty God, The everlasting Father, The Prince of Peace?
If "a child has been born" (past tense) then that child cannot be the historical Jesus of Nazareth as he was not born at the time that Isaiah was written (circa 740 to 700 BCE).
